ILR applications in all eligible routes
Indefinite Leave to Remain (ILR) grants individuals the right to live in the UK permanently without immigration restrictions. ILR is often a key step before applying for British citizenship.
-
- Eligibility: Applicants must have lived in the UK under a qualifying visa category (such as a work visa or family visa) for a specified period, typically five years. Certain categories, such as investor or innovator visas, may qualify earlier.
- Application Process: Applicants must provide proof of residence, employment, and financial stability, as well as pass the Life in the UK test and demonstrate English language proficiency.
- Routes to ILR: Common routes to ILR include Skilled Worker visas, Spouse visas, and long-term residency, such as continuous lawful residence for 10 years.
- Absence Limit: Applicants must not have spent more than 180 days outside the UK in any 12-month period during their qualifying time.
- Health Surcharge: ILR holders are no longer required to pay the Immigration Health Surcharge and can access the National Health Service (NHS).
- Employment Rights: With ILR, individuals can work in any job or start their own business without sponsorship.
- Family Members: Dependents, such as spouses and children, may also apply for ILR if they meet the residency requirements.
- ILR for Refugees and Asylum Seekers: Refugees and those granted humanitarian protection are eligible for ILR after five years of continuous residence in the UK.
- Permanent Residence for EU Nationals: Under the EU Settlement Scheme, EU nationals and their family members can apply for ILR (settled status).
- Pathway to Citizenship: After holding ILR for 12 months, individuals can apply for British naturalisation, provided they meet the residency and good character requirements.
